### Award Criterion Descriptions

- In the evaluation of the sub-criterion "Price", Port of Hirtshals will emphasize the total evaluation technical tender price excluding VAT, which is stated in the Form of Bill of Quantities. The total evaluation technical tender price is calculated on the basis of the total tender price for the extension of the western breakwater as well as the sum of the option prices (Shortening of existing eastern breakwater), where the sum of the option prices is included in the total evaluation technical tender price with 10 % of the total value. For the purpose of the evaluation of the tender in relation to the sub-criterion "Price", the tenderer must complete and sign the "Bill of Quantities" included in the tender documents. All prices in the Form of Bill of Quantities must be stated in DKK excluding VAT. Note: An uncompleted record or a completed record with DKK 0 or with characters or letters means that the tenderer will be obliged to provide the services at DKK 0.
- The tenderer must submit along with the tender a presentation folder for the tender response for the sub-subcriterion "Process description. The presentation folder for the tender response for the sub-subcriterion "Process description", must contain: - Descriptions that cover WS1 (the description for WS1 should not exceed 3 A4 pages). - Descriptions that cover WS2 to WS4. In the tenderers description covering WS2 the tenderer must inform which amour units for armour layer the tenderer will construct the western breakwater with. (the description should not exceed 5 A4 pages). When evaluating the sub-subcriterion, "Process Description" Port of Hirtshals will emphasize that: - The tenderer’s presentation folder includes descriptions for WS1-WS4 presenting a clear and robust method description of the contractors’ work. - The tenderer’s description shows that the Tenderer has clearly understood the work process. - The tenderer offers to execute the works using good robust machinery that is well-suited for the job. - The tenderer offers to execute the works by applying environmentally friendly measures during the performance of the works, such as offering to carry out the works using low-emission machinery, reducing idling time, or heating the site facilities with heat pumps or using LED lighting, etc. - The tenderer’s description shows clear logistic of the execution of the main contract. - The tenderer’s description offers effective workflows to ensure the continuant operation of the commercial port with ferry services. - The tenderers description shows that the tenderer has a good understanding of the risk involved in the construction works and that the descriptions presents effective mitigating actions to such risks.
- The tender should contain the following: 1) CVs for the following key persons: - a Main project manager. - a Foreman for the breakwater. Also, the tenderers may (it is not mandatory) submit a CV for a Project manager for the breakwater. CVs for each of the key persons mentioned above shall include a description of the following information: - Key qualifications and competences in relation to the solution and realisation of the breakwater project. - Education and completed courses. - Past experience with a more detailed explanation of what the main project manager and the foreman for the breakwater and (if offered) the project manager for the breakwater has contributed with to previous projects. (Each CV should not exceed 3 A4 pages). It is a Minimum Requirement (MR) that the CV’s show that the main project manager or (if offered) the project manager for the breakwater have a minimum of 10 years of professional experience and have experience from at least two prior port projects involving the construction of breakwaters, in which they have acted as project manager or main project manager. It is not a Minimum Requirement (MR) that both the main project manager and (if offered) the project manager fulfill the said requirements. The Minimum Requirement (MR) is fulfilled as long as one of the two (the main project manager or (if offered) the project manager) fulfill the said requirements. 2) An overview of any other employees that the tenderer assigns as key persons, with a detailed description of the background for the composition of the key persons with an elaboration of their competences and experience. (The description should not exceed 2 A4 pages per key person) 3) A description of the tenderer's project organization, including workflows, working methods and knowledge sharing as well as number of employees and ownership. (The description should not exceed 3 A4 pages) When evaluating the sub-subcriterion, "Organization and key persons" Port of Hirtshals will emphasize that: - The offered key persons have relevant experience, including that the main project manager and the foreman for the breakwater and (if offered) the project manager for the breakwater have in-depth and solid experience from comparable breakwater projects. - The offered key persons' contribution to the project is relevant and that the composition of the key persons is optimal in relation to the project. - The project organization possesses sufficient competencies and resources to ensure that the project organization is robust, including that the project organization has experience in managing and coordinating similar projects. - The Tenderer offers a project organization with clear and logical authority and responsibility relations. - The project organization understands and can navigate a project that has political attention. - The tenderer's described approach to working with Port of Hirtshals and its advisors ensures that the cooperation will be effective and provide Port of Hirtshals with relevant and sufficient information about the progress and any challenges of the works.
- The tenderer must offer to perform the works comprised by the Main Contract either: - with completion and handover within 3 seasons (no later than 31 October 2029) or - with completion and handover within 4 seasons (no later than 31 October 2030) The tenderer must in the Form of Bill of Quantities cross out only one of the boxes indicating the offered performance period of the works. If the tenderer offers to perform the works comprised by the Main Contract with completion and handover within 3 seasons (no later than 31 October 2029), the tender will be awarded 100 points for the sub-criterion, “Time/Season”. If the tenderer offers to perform the works comprised by the Main Contract with completion and handover within 4 seasons (no later than 31 October 2030), the tender will be awarded 0 points for the sub-criterion, “Time/Season”.

### Selection Criterion Descriptions

- Applicants must fulfil the following minimum requirements: An annual turnover of at least EUR 50 million in each of the last three completed financial years. "Completed financial years" means the three most recent financial years for which there are approved financial statements.
- Applicants must fulfil the following minimum requirements: A solvency ratio of at least 15 % in each of the last three completed financial years. "Completed financial years" means the three most recent financial years for which there are approved financial statements.
- Applicants must fulfil the following minimum requirements: An equity capital of at least EUR 15 million in each of the last three completed financial years. "Completed financial years" means the three most recent financial years for which there are approved financial statements.
- Applicants must fulfil the following minimum requirements: The auditor must not in the most recently completed financial year have expressed reservations about the applicant's continued operation ("going concern", i.e. the presumption of the company's continued operation). "Completed financial year" means the most recent financial year for which there is an approved financial statement.
- The applicant must fulfil the following minimum requirements: - The applicant must have carried out at least 1 similar assignment/reference that is ongoing or completed within the last 10 years (calculated from the application deadline). The determination of the 10 years is based on an assessment that this is necessary to ensure sufficient competition. The assignments/references are considered "completed" when the construction work is handed over. "Similar assignments/references" means that: -The assignment/reference includes construction of breakwaters. The applicant must submit assignments/references, which should include a description of the nature and scope of the assignments/references, the building owner of the assignment/reference, contract value concerning the works on the construction of breakwaters with in-house share, location, time of performance and completion of the assignment/reference, contact person and which part of the assignment/reference the applicant has been responsible for the execution of. The assignment/reference can be ongoing, however, the works concerning construction of breakwaters for the specific assignment/reference must have been fully performed (not necessarily handed over) at the time of the submission of the application. In case that the assignment/reference is ongoing, the applicant must indicate that the works concerning construction of breakwaters have been fully performed. In order to fulfill the minimum requirement, the Applicants need only list one (1) assignments/references complying with the requirements listed above. However, Applicants are encouraged to list a maximum of 5 assignments/references. Providing more than 5 assignments/references will not result in the application being considered non-compliant. However, Port of Hirtshals will only emphasize the first 5 assignments/references in the selection, which is why the applicant is requested to number the assignments/references by stating no. 1, no. 2, etc. Port of Hirtshals can include assignments/references in the selection that do not comply with the minimum requirements listed above, however at least one (1) assignment/reference must meet the minimum requirements in order for the applicant to be considered eligible for prequalification. Note: If the applicant is a consortium/similar association or relies on the technical or professional capabilities of other entities (e.g. support services) to fulfil the minimum requirements, a separate ESPD must be submitted for each participant in the consortium/association. In addition, for applicants relying on the capacity of other entities to fulfil the minimum requirements, the applicant must provide, as part of the documentation, a statement of support or equivalent documentation proving that the entity in question is legally committed to the applicant. Documentation: The reference list to be included in the ESPD is considered by Port of Hirtshals to be the final documentation of the applicant's technical and professional capabilities. In the event that Port of Hirtshals receives applications from more than 3-5 eligible companies/consortia, Port of Hirtshals will select the 3-5 most eligible companies/ consortia. When assessing which companies/consortia are most eligible, Port of Hirtshals will emphasize the following: - How large a part of the execution of the assignment/reference concerning the construction of breakwaters the applicant has been responsible for as a larger part, weighs more positively than a smaller part. - That the applicant's assignments/references are relevant, meaning that: - The assignments/references are of the same or larger complexity as the tender, including that the assignments/references have included the construction of breakwaters at similar water depth and wave climate as the main contract that is out for tender. Reference is made to the Metocean rapport (Appendix B.1.1) and the Report on Weather down time analysis (Appendix B.1.2) and included in the tender material. - The assignments/references are new. - The contract value for the works concerning the construction of breakwaters is essentially identical to or larger than the budgeted construction budget. For the purpose of selection, the applicant must complete the ESPD, section V. With regard to the above, the applicant may refer to the information provided for the assessment of the fulfilment of the minimum requirements. Port of Hirtshals encourages the applicant to prioritize the list of references so that the most relevant is listed as no. 1, the next most relevant reference as no. 2 and so on. If more than 5 references are stated, Port of Hirtshals will only emphasize the first 5 references in the applicant's prioritized list or the 5 references that appear first in the ESPD. Between three (3) and five (5) applicants will be prequalified. The final number of prequalified applicants will depend on the overall assessment of the applicants’ assignments/references based on the selection criteria. If there is a clear qualitative difference between the applicants in terms of relevance, complexity, scope of responsibility and contract value of the reference projects, fewer applicants will be prequalified. If several applicants are assessed as being similarly and qualified, up to five applicants will be prequalified.” If Port of Hirtshals only receives three or less eligible applications, Port of Hirtshals may prequalify the eligible applicants without conducting a selection.
- The applicant must fulfil the following minimum requirements for the applicant's quality assurance standards: ISO 9001 quality management system or equivalent.

### Options

- The tender contains the following option concerning works, that Port of Hirtshals may call on the Contractor to perform: • Shortening of existing eastern breakwater. The option consists of two elements: 1) The services etc. to produce a condition assessment/suitability evaluation of the caissons. 2) Works for the removal of the outermost 60 metres of the East breakwater, and the construction of a new rubble-mound breakwater head. The Client must inform the contractor whether the Client wishes to activate the services etc. to produce a condition assessment/suitability evaluation of the caissons no later than 31 December 2026, as the contractor must, as the first step before any further work on the East breakwater Option, carry out such a condition assessment/suitability evaluation of the caissons to determine the feasibility of lifting and moving them. If the Client activates this first part of the East breakwater Option, this assessment must be conducted during the first season (2027) of the actual construction of the West breakwater to allow sufficient time for the Client to design an alternative solution for the relocation of the Eastern breakwater without using caissons, if necessary. Upon receiving the condition assessment/suitability evaluation of the caissons, the Client will assess whether the relocation of the caissons is realistic. No later than a year after receiving the condition assessment/suitability evaluation of the caissons, the Client must inform the Contractor, whether the actual works concerning the Eastern Breakwater shall continue/commence.

## Description

Port of Hirtshals is a public limited port company subject to regulation in the Danish law for harbours called "havneloven". Port of Hirtshals currently comprises the following facilities: - West harbour at Hirtshals with small ship yard, fishing boats and the fish auction terminal - East harbour at Hirtshals with 3 big ferry terminals, big fishing boats with related cold storage facilities and a bigger ship yard. Port of Hirtshals has a total area of approximately 1.1 million square metres and is already among the 10 largest ports in Denmark in terms of turnover. As a result of the growing transit from and to Norway and the Atlantic area, Port of Hirtshals sees a demand and a need to accommodate bigger vessels calling the harbour and being a harbour towards the North Sea which is challenging in all-weather situations all year around. The ambition is to map Port of Hirtshals as a key port in the northern part of Denmark both towards Norway and the Atlantic but also as a suited transit port going in and out of the Baltic Sea. With the improved entrance enabling larger vessels to call the port, it should be a commercial decision to use the port and not a maritime decision, meaning that vessels can enter safely in all-weather all year round. Furthermore, the port will develop new logistic areas with long berths with possible Ro-Ro facilities. The port is part of the business Greenport Scandinavia establishing a hub for CO2 storage with storage facilities on land both coming in from emitters around the Baltic Sea but also going out into the end storage below the North Sea. The main contract which is out for tender marks the initial phase of the port’s expansion, specifically focusing on the extension of the western breakwater. The project aims to improve navigation conditions and maneuverability for vessels up to 200–250 meters in length, ensuring safe and efficient access to the port year-round, even in challenging weather conditions with winds up to 20 m/s and waves up to 6 m. This expansion is essential to accommodate the growing demand from existing and new customers operating larger, modern vessels, including RoRo and RoPax ships. The scope of the tender includes the following core tasks: • Demolition of the existing western breakwater including existing caissons • Construction of new western breakwater with a length of approximately 730 m • Construction of roundhead. The new western breakwater will be constructed from a point on the existing western breakwater. The breakwater will be constructed on a water depth from app. 3 m at the connection to the existing breakwater to a water depth of approximately 13 m at the new roundhead. The crest varies from level +5 m at the inner part to level 9.5 m at the roundhead. The new breakwater will be constructed reusing material from the demolition of the existing breakwater and from new material. The tender contains the following option concerning works, that Port of Hirtshals may call on the Contractor to perform: • Shortening of existing eastern breakwater. The performance of the Main Contract is to be conducted during 3 or 4 seasons. The tenderers must in their tender specify whether the tenderer offers to perform and complete the works with handover within 3 seasons (no later than October 2029) or with handover within 4 seasons (no later than October 2030). The main contract is only entered into on the condition that: - Port of Hirtshals obtains the necessary administrative approvals and permits - Hjørring Municipality approves the loan guarantee for the project. All communication during the tender process must be in Danish or English. The tender is conducted electronically using the electronic tendering platform The www.eu-supply.com.
