ETK offentliggør hermed Notification of Intent for nedenstående projekt på vegne af NATO. Det danske forsvar finansierer ikke projektet.

a. Applicable legislation

This contract is based on the Law of 13 August 2011 relating to public contracts and certain works, supply, and service contracts in the fields of defense and security, as well as its implementing decrees (AR1 and AR2).

b. Nature of the public contract:

Public works contract.

Estimated value: €120,000,000-€150,000,000 

The Belgian Ministry of Defense is launching this call for tenders within the framework of an investment program financed by NATO (NATO Security Investment Program - NSIP).

Subject of the Public Contract

This contract covers, firstly, the renovation of the quay walls, the quays themselves, and their infrastructure, as well as the facilities/technical infrastructure (fuel and water supply, electricity supply, etc.), and secondly, the deepening (to -11m) of Dock 1 at the Zeebrugge Naval Base.

This infrastructure work is necessary to accommodate various types of current and/or future Belgian vessels (such as the new mine countermeasures platforms (MCMPF) or the new anti-submarine warfare frigates (ASWF) from 2030 onwards). The dock must also be able to accommodate Dutch vessels, vessels from other NATO member countries, and RoRo (Roll-on Roll-off) vessels for loading and unloading rolling stock.

The renovation of Dock 1 will enable it to meet NATO maritime infrastructure standards.

The project will be executed through a Build contract.

The technical specifications were established by the engineering firm SBE, contracted by the Ministry of Defence and specializing in maritime civil engineering. The contractor will have access to the completed design plans. The work is expected to take approximately three years.

d. Procurement Method:

NCB+ (National Competitive Bidding Plus), which results in a Negotiated Procedure with prior publication in accordance with applicable national laws.

3. Selection and exclusion criteria

Based on the applications submitted, an analysis will be conducted

Candidates not selected will receive the reasons for their non-selection in the form of a Selection decision.

Only selected candidates will receive the specific terms and conditions relating to the public contract in question.

4. Applications to Participate

a. Submission of an Application to Participate by a Joint Venture

Each member of a joint venture without legal personality is considered a candidate.

At all stages of the procurement procedure, the contracting authority reserves the right to admit a joint venture without legal personality if one or more members do not meet or no longer meet the selection criteria and/or if there are grounds for exclusion, provided that:

The member(s) of the joint venture are withdrawn or replaced;

The newly formed joint venture and all its members meet the selection criteria and there are no grounds for exclusion;

The new joint venture agrees.

b. Submission of Applications to Participate

Each candidate may submit only ONE application to participate.

Applications to participate must be submitted electronically via the e-procurement application (BOSA eProcurement (publicprocurement.be)). Paper applications are not permitted.

C. Language

The application must be written entirely in either French or Dutch, to the exclusion of any other language.

Dispatch of the Special Terms and Conditions

The Contracting Authority will send the Special Terms and Conditions to the selected applicants, possibly accompanied by additional terms and conditions (estimated date: November 2026).

Procedures for Submitting Applications to Participate Electronically:

The application to participate is signed in its entirety on the corresponding submission report. Therefore, an individual signature on the application is not required. The submission report must be signed using a qualified electronic signature, in accordance with the rules of European law, according to which the signature is created using an electronic signature creation device qualified as an electronic signature (Article 3, 12° of EU Regulation 910/2014). A qualified electronic signature, based on a qualified certificate, is required.

The services of the FPS BOSA (Federal Public Service Strategy and Support) will verify whether the (qualified) electronic signature meets the required standards.

The electronic participation request is submitted via the e-procurement platform.

Submission of Bids:

The actual deadline will be included in the special terms and conditions (estimated date: January 2027).

Analysis and negotiations:

The bids will be evaluated, and negotiations will be held with the bidders.

Validity of bids: will be included in the special terms and conditions.

Contract award:

The above deadlines are currently for informational purposes only and may be subject to change.

Given the complexity of the contract and to avoid any uncertainty regarding the call for tenders, the Contracting Authority has decided to hold a preliminary information session for potential candidates between the publication of the contract notice and the opening of applications.
