### Award Criterion Descriptions

- Contract price must be completed and submitted together with the additional tender material. All fields must be completed, and the tender must be made in Euro (EUR) exclusive of VAT. The price (the tenderers offered price) equals the total price calculated on the basis of the price sheets by multiplying the price per unit or the hourly rate by the related quantities and adding up the total price.
- The tenderer is requested to describe the technical solution in his offer. The assessment will include, among other things: • The overall transformer design and technical concept. • The proposed measures to ensure operational reliability and maintainability. • The proposed cooling arrangement and serviceability of key components. • The proposed approach to condition monitoring and diagnostics. • The extent to which the proposed solution facilitates efficient operation and maintenance throughout the expected service life. A higher score will be awarded to solutions demonstrating a robust and well-documented technical design with clear benefits in terms of operational reliability, maintainability, availability, serviceability, condition monitoring and lifecycle performance. The tenderer is requested to describe the project execution in his offer. The assessment will include, among other things: • The proposed project execution plan. • The proposed approach to coordinating manufacturing, delivery and installation activities with the overall project programme. • The proposed approach to managing interfaces with other contractors and project activities. • The proposed measures for mitigating schedule and delivery risks. A higher score will be awarded to tenders demonstrating a well-documented, robust and realistic execution strategy, including effective interface management, proactive risk management and a clear project organization, thereby minimizing project risks and supporting timely completion of the Works. The tenderer's response for Lot 1 under Technical Solution and Project Execution shall not exceed thirteen (13) A4 pages. The response shall be prepared using a minimum font size of 11 pt. The front page and table of contents shall not count towards the page limit. Figures, tables, diagrams and illustrations are included in the page limit. Information exceeding the page limit will be disregarded by HOFOR.
- The sub-criterion Commercial and Contractual Terms will be evaluated based on the tenderer's deviations from the contractual documents and the extent to which the tenderer accepts the contractual documents. The evaluation will be based on the tenderer's SMC1_A6_6.2_C08.03_N1.0.2 List of Reservation and any proposed amendments submitted as part of the tender. The evaluation will include deviations from the following documents and provisions: • HAB-ME26 – General Conditions: o Clause 1.3 (Intellectual Property Rights) • Special Conditions: o Clause 11 (Additional Works) o Clause 14 (Time Schedule) o Clause 15 (Handing Over) o Clause 17 (Price Regulation) o Clause 19 (The Contractor's Liability for Delay) o Clause 20 (The Employer's Liability for Delay) o Clause 21 (Liquidated Damages for Performance) o Clause 22 (Termination) o Clause 23 (Warranty) • Contract Programme – Power Transformer A higher score will be awarded to tenders accepting HOFOR's proposed contractual framework and risk allocation with only limited deviations. A tender accepting all such clauses and/or documents will receive the maximum score as the best possible fulfilment of the criterion. A submitted empty SMC1_A6_6.2_C08.03_N1.0.2 List of Reservations and without any proposed deviations from the contractual documents listed above will be deemed to constitute full acceptance of HOFOR's contractual framework and risk allocation. A lower score will be awarded where deviations increase HOFOR's contractual, commercial, programme-related or operational risk. Any ambiguities in the division of obligations will be considered an increased risk for HOFOR. As part hereof it will be evaluated negatively (non-prioritized order): a) Use of the Works If the tenderer imposes deviations that hinder and/or impede HOFOR's ability to operate, maintain, repair and replace the transformers and associated equipment in accordance with its intended purpose for the operational lifetime of the project. b) Flexibility If the tenderer imposes deviations that interfere with or otherwise impede HOFOR's ability to control and adapt the project, including introducing changes to the Works. c) Securities, Ownership and Financial Exposure If the tenderer imposes deviations towards securities, guarantees, payment terms, ownership rights, price adjustment mechanisms or other commercial provisions that separately or in combination increase HOFOR's exposure in the event of cancellation, default, termination or cost escalation. d) Openness and Cooperation If the tenderer does not assume appropriate obligations to share information, provide documentation and cooperate proactively with HOFOR and other contractors engaged by HOFOR with a view to supporting the overall project. e) Timely Delivery if the tenderer deviates from the contractual allocation of programme risks, extension of time provisions, milestone obligations, delay liquidated damages and other mechanisms intended to ensure timely completion of the Works. f) Defects and Liabilities if the tenderer imposes deviations that hinder and/or interfere with HOFOR's rights in relation to; (i) qualification, identification and timely rectification of defects, (ii) the warranty obligations and warranty period, (iii) the Contractor's liability for defects and performance shortfalls, (iv) the extent of liabilities undertaken by the Contractor under the Contract.
