  • Contract Terms

Beskrivelser af tildelingskriterier

  • Prices must be stated in the attached Commercial tender list, cf. doc. 25/17895-28 (Lot specific sheets), for each lot for which the tenderer is prequalified. The defined price elements for all lots for which the tenderer is prequalified must be completed herein. Prices must be stated exclusive of VAT but inclusive of all other expenses associated with the purchase (including taxes). Prices must be stated in Euro. When evaluating 'Price' Energinet will include the price for each lot individually, cf. the sheets in Commercial tender list, cf. doc. 25/17895-28. The total price per lot is calculated for evaluation purpose only.
  • For each lot under the framework agreement, the tenderer must specify guaranteed delivery times for all components listed in the respective sheets in the document Commercial tender list, cf. doc. 25/17895-28. Delivery times must be stated in calendar days, measured from the Contracting Authority’s order to the final delivery at the designated delivery location. The delivery times must be entered in the relevant sheets in Appendix 3 – Commercial tender list, cf. doc. 25/17895-28. If delivery times vary between components within a lot, the evaluation will be based on the longest guaranteed delivery time stated for that lot. Incomplete delivery time information will be considered non compliant. The sub criterion “Delivery Time” will be evaluated per lot. For each lot, the score will be based on the longest guaranteed delivery time stated for any component within that lot. Scoring Model Lots 1 and 3 • A delivery time of 240 calendar days results in a score of 10. • A delivery time of 420 calendar days results in a score of 0. • Intermediate delivery times will be evaluated using linear interpolation. Delivery times exceeding 540 calendar days will not be accepted and will render the tender for the affected lot non compliant, cf. section 2.7.1 of the tender conditions. Lot 2 • A delivery time of 240 calendar days results in a score of 10. • A delivery time of 600 calendar days results in a score of 0. • Intermediate delivery times will be evaluated using linear interpolation. Delivery times exceeding 720 calendar days will not be accepted and will render the tender for the affected lot non compliant, cf. section 2.7.1 of the tender conditions.
  • For the evaluation of the sub-criteria the following should be enclosed: If the tenderer includes a list of proposed deviations to the attached contractual terms: • Agreement under Framework Agreement (doc. no. 25/17895-34/35/36), • Appendix 1: General Terms and Conditions for Purchase (doc. no. 25/17895-37) the tenderer must use the Clarification List (doc. no. 25/17895-6). Tenderer must make it clear whether deviations applies to a specific lot or to all lots. The proposed deviations to the contractual terms must be stated in the spreadsheet marked “Legal clarification” and should be explicit and with explanation as to why they are made. The tendered assignment must be performed based on the attached contract terms. The tenderer may, however, suggest explicit and well-explained deviations to the contractual terms which the Contracting Authority has identified as competitive criteria below: • Appendix 1: General Terms and Conditions for Purchase (doc. 25/17895-37) and, where relevant, same Clauses and Sub-Clauses in the Agreement under the Framework Agreement (doc. no. 25/17895-34/35/36): o Clause 9 (Time of Delivery) o Clause 11 (Intellectual property rights) o Clause 12 (Late-delivery or non-delivery) o Clause 13 (Defects and remedies) o Clause 14 (Limitation of liability) o Clause 15 (Product liability) o Clause 16 (Insurance) o Clause 17 (Indemnification) o Clause 18 (Performance guarantee) * o Sub-Clause 20.3 (HSE requirements) o Clause 25 (Termination) * However, the following remain requirements regarding the performance guarantee: • A performance guarantee must be issued if the Contract Price equals or exceeds 2,000,000.00 EUR. • The performance guarantee must be an on-demand guarantee issued by a financial institution or other authorised guarantor with a minimum rating of the investment grade level at BBB- (Standard&Poors or Fitch) or Baa3 (Moody’s). • The wording in the performance guarantee template regarding Disputes and Applicable law Deviations to the clauses listed above will be included in the evaluation of the sub-criterion "Contract terms" and it is noted that any deviations may lead to a reduction to the score depending on the content, clarity, and consequence. In this regard it is explicitly noted that deviations which are intended to limit liability and shift the financial risk in favor of the tenderer will be of particular importance in the evaluation. No deviations, and therefore absolute fulfillment of the contract terms, will result in the maximum score of 10. An overall evaluation will be made of this sub-criterion. A minimum score of 4 must be achieved, cf. sub-section 3.7.1
