Beskrivelser af tildelingskriterier
- Prices must be stated in the attached Appendix 3: Tender List (ABA + KEL) (doc. no.: 23/01546-25 and the defined price elements must be completed herein. Prices must be stated exclusive of VAT but inclusive of all other expenses associated with the purchase. Prices must be stated in EUR. When evaluating 'Price', the Contracting Authority will evaluate the total cost (for evaluation purpose), cf. the Tender List.
- The tenderer must include: • A detailed and Technical specific solution for the tendered assignment and how Technical Specifications are fulfilled. Including a description of the chosen methods, processes, tools, and relevant spare parts. • Layout and drawings of filter solution. The tenderer should be thorough and precise when describing the solution description, as any insecurities and discrepancies may affect the evaluation. The evaluation does not include sound levels which are evaluated solely in relation to the criteria described below. The evaluation of 'Solution description' will be based on the submitted detailed and specific solution description, the scope and content and the described methods, processes and tools used. In this context, the elements listed below are of particular importance: Tenders’ description of: • The overall technical solution for the Filter performance according to Appendix 2A Scope of Works and Technical Specifications (doc. no. 23/01546-16 and 23/01546-17). That is to which extent the detailed solution description demonstrates a high level of ability to identify relevant activities and challenges and proposes appropriate and project specific methods, tools, and processes for managing such. • Size – Height x Width x Depth – it will be evaluated positive if tenderer’s solutions have a small footprint within the filter yard. Furthermore, it will be evaluated positive if the design of the filter(s) is based on a low-profile solution. • FAT & SAT - it will be evaluated positive if tenderer enclose a detailed, specific, and appropriate procedure specific to this Tender • General design – It will be evaluated positive if the tenderer’s solution is project specific, simple, and robust and the tenderer can document low maintenance costs. An overall evaluation will be made of these sub-criteria (solution description). A minimum score of 4 must be achieved, cf. sub-section 2.7.1.
- The evaluation of the subcriterion “Sound level” will be based upon the specifications given in section 4.1 and 9.1 in Appendix 2A Scope of Works and Technical Specifications (doc. no. 23/01546-16 and 23/01546-17). The tenderer must include a detailed and specific solution description for the tendered assignment, including chosen methods, processes and tools. The evaluation of guaranteed sound level (cf. section 9. Sound Level in Appendix 2A Scope of Works and Technical Specifications (doc. no. 23/01546-16 and 23/01546-17) is performed in 3 steps: 1. Sound power level: The evaluation of guaranteed sound levels (see section 11. The sound level in Annex 2A scope of work and technical specifications (doc. nos. 23/01546-16 and 23/01546-17) is carried out in the following steps: 1. Sound power level LWA: a. If the supplier presents a solution where the guaranteed sound power level is higher than specified by the contracting authority, the guaranteed sound level is too high. The solution will get a score of 0 (zero). In addition, if the sound power level is more than 3 dB higher than required, the contracting authority reserves the right to disregard the tender as the minimum technical requirements are not met. b. If the guaranteed sound power level is equal to or lower than the maximum volume level, the score is 5 (five) c. If external methods of sound damping methods such as sound screens are used, 3 (three) points will be deducted from the score obtained in point b). d. If the sound power level is LOWER than the maximum sound power level accepted by the contracting authority: The final assessment is obtained by adding 1 (one) point to the preliminary assessment { b) + c) } for each dB that the guaranteed sound power level is lower than the maximum value required. The resulting grade cannot exceed the value of 10 (ten), so no points are given for sound levels more than 10 dB lower than the required maximum value
- For the evaluation of the sub-criteria the below should be enclosed: If the tenderer includes a list of proposed deviations to the attached contractual terms: • Contract Agreements (doc. no. 23/01546-9 and 23/01546-10), • Appendix 1: General Terms and Conditions for Purchase (doc. no. 23/01546-12), • Appendix 4 Time and Payment Schedule, (doc. no. 23/01546-27 and 23/01546-28) The tenderer must use the Clarification List (doc. no. 23/01546-11). The proposed deviations to the contractual terms must be stated in the spreadsheet marked “Legal clarification” and should be explicit and with explanation as to why they are made. The tendered assignment must be performed on the basis of the attached contract terms. The tenderer may, however, suggest explicit and well-explained deviations to the contractual terms which the Contracting Authority has identified as competitive criteria below: • Appendix 1: General Terms and Conditions for Purchase (doc. no. 23/01546-12) and, where relevant, same Clauses and Sub-Clauses in the Contract Agreements (doc. no. 23/01546-9 and 23/01546-10): o Clause 2 (Requirements), except for Sub-Clause 2.3 o Sub-clause 4.6 (Advance payment guarantee – except for what is stated as requirements below) o Clause 9 (Time of Delivery) o Clause 11 (Intellectual property rights) o Clause 12 (Late-delivery or non-delivery) o Clause 13 (Defects and remedies) o Clause 14 (Limitation of liability) o Clause 15 (Product liability) o Clause 16 (Insurance) o Clause 17 (Indemnification) o Clause 18 (Performance guarantee – except for what is stated as requirements below) o Sub-Clause 20.3 (HSE requirements) o Clause 25 (Termination) • Appendix 4: Time and Payment Schedule (doc. no. 23/01546-27 and 23/01546-28)) Regarding the Performance Guarantee (regulated in Clause 18) and the Advance Payment Guarantee (regulated in Sub-Clause 4.6): It is a requirement to issue a Performance Guarantee. It is also a requirement that the guarantees are on-demand guarantees issued by a financial institution or other authorised guarantor with a minimum rating of the investment grade level at BBB- (Standard&Poors or Fitch) or Baa3 (Moody’s). If the market is unable to offer such a rating, due to a general crisis in the market, “Seller must obtain the best possible rating the market can offer”. Finally, the wording in the guarantees regarding Disputes and Applicable law is a requirement. These will be included in the evaluation of the sub-criterion "Contract terms" and it is noted that any deviations may lead to a reduction to the score depending on the content, clarity, and consequence. In this regard it is explicitly noted that deviations which intends to limit liability and shift the financial risk in favor of the tenderer will be of particular importance in the evaluation. No deviations, and thereby absolute fulfillment of the contract terms, will result in the maximum score of 10. An overall evaluation will be made of this sub-criterion. A minimum score of 4 must be achieved, cf. sub-section 2.7.1.
